Federal sentencing mitigation is specialized work. It is time-consuming, it requires a deep familiarity with what federal judges actually respond to, and it is almost entirely separate from the work of defending the charges.
Most defense attorneys — even excellent ones — don't do it at the level the federal system demands. Not because they don't care, but because there are only so many hours in a case.
I do this work exclusively. And I collaborate with defense attorneys who want their clients to have the full benefit of it without having to build that capability in-house.
What the Collaboration Looks Like
Your client relationship stays yours. I work alongside your defense team — not around it — and I adapt to whatever role makes sense for the case.
Some attorneys bring me in at the outset, when a client first learns they're under investigation. Others reach out when a plea is imminent and the sentencing timeline is set. Either way, the earlier I'm involved, the more the work can accomplish.
What I handle:
The personal narrative. I spend real time with your client — understanding their history, their family, the circumstances that led to this moment — and I build that story into every document that reaches the prosecutor, the probation office, and the court.
Probation office strategy. The presentence report is one of the most consequential documents in a federal case. I work to make sure the probation officer writing that report understands who your client is as a person, long before the report is finalized.
Early engagement with the AUSA. In appropriate cases, I present mitigation materials to the prosecutor before the PSR is written — sometimes before charges are filed. Prosecutorial discretion is real, and it can be influenced when the work is done early and done well.
The sentencing memorandum. I write these carefully, because federal judges read them carefully. The memo addresses the guidelines, your client's history and characteristics, the nature and circumstances of the offense, and the argument for why a sentence below the guidelines is appropriate.
Allocution preparation. Your client will speak directly to the judge. I make sure they're ready for that moment.
Results
The measure of this work is in the outcomes.
I represented Mathew Bowyer — the bookmaker at the center of the Shohei Ohtani gambling scandal — from the day of the FBI, IRS, and Homeland Security raid through sentencing. The guidelines range was 47 to 56 months. The probation office recommended 36 months. The government recommended 15 months.
Judge Holcomb sentenced Matt to a year and a day.
That outcome was the result of years of deliberate mitigation preparation — cooperation strategy, character documentation, and a sentencing memorandum that gave the court a complete picture of who Matt Bowyer is as a person. It is not an outlier. It is what this kind of work, done early and done thoroughly, makes possible.
I had a client charged in a $50 million immigration fraud case who was sentenced to probation.
I had a client who was facing a 10 year mandatory minimum after trial on a drug trafficking case who was sentenced to six months.
