Assault and Battery

There are several different kinds of assault. Simple assault is usually filed in conjunction with battery charges. These cases generally involve bar fights or other fights between individuals where no weapon is used. Simple assault does not require any intent. Simple assault is a misdemeanor.

Assault with a Deadly Weapon

This type of assault can involve a firearm or any other object which could inflict great bodily injury. This charge is usually filed as a felony and can be a strike.

Battery

Battery is the unlawful use of force or violence on another. Battery is a misdemeanor.
